CONCERNING
LIST OF ACTIVE MATERIALS OF PROHIBITED PESTICIDES AND RESTRICTED PESTICIDES

WITH THE GRACE OF THE ALMIGHTY GOD
THE MINISTER OF AGRICULTURE,

Attachment

Considering:

• a. that, based on Decree of the Minister of Agriculture No. 343.1/KPTS/TP.270/2001 concerning Conditions and Procedures of Pesticide Registration, pesticides with the criteria as described in Article 5 paragraph (3) are classified as prohibited pesticides;
• b. that, based on Decree of the Minister of Agriculture No. 434.1/KPTS/TP.270/7/2001 concerning Conditions and Procedures of Pesticide Registration, pesticides with the criteria as described in Article 5 paragraph (5) are classified as restricted pesticides;
• c. that, based on the above matters, it is deemed necessary to stipulate list of active materials of prohibited pesticides and list of active materials of restricted pesticides;

In view of:

• 15. Regulation of the Minister of Agriculture No. 341/KPTS/OT.140/7/2005 concerning Organization Structure and Work Procedure of the Ministry of Agriculture;
• 16. Decree of the Minister of Agriculture No. 42/KPTS/OT.160/9/2005 concerning Pesticides Commission;

Observing:

Opinion of Pesticides Commission in its letter No.../Kompes/2006 dated ... 2006[sic];

HAS DECIDED:

To stipulate:

LIST OF ACTIVE MATERIALS OF PROHIBITED PESTICIDES AND RESTRICTED PESTICIDES.

Article 1

(1) Stipulating active materials of prohibited pesticides as set forth in Attachment I to this Regulation.

(2) Stipulating active materials of restricted pesticides as set forth in Attachment II to this Regulation.

Article 2

Pesticides containing active materials as described in Article 1 paragraph (1) may not be imported or manufactured domestically.

Article 3

If the pesticides as meant in paragraph (2) are in Indonesian territory, they shall be exited from the Indonesian territory or destroyed by the owners or the controlling parties which will be implemented in accordance with the regulations in force.

Article 4

With the stipulation of this Regulation Circular of Pesticides Commission No. 166/Kompes/2004 dated April 28, 2004 is declared inapplicable.

Article 5

This Regulation comes into force as from the date it is stipulated.
